Conditions

Annex 1 Mandatory Conditions 1 No supply of alcohol may be made under the Premises Licence a At a time when there is no Designated Premises Supervisor in respect of the Premises Licence or b At a time when the Designated Premises Supervisor does not hold a Personal Licence or his Personal Licence is suspended 2 Every supply of alcohol under the Premises Licence must be made or authorised by a person who holds a Personal Licence 3 1 The responsible person must ensure that staff on relevant premises do not carry out arrange or participate in any irresponsible promotions in relation to the premises 2 In this paragraph an irresponsible promotion means any one or more of the following activities or substantially similar activities carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises a games or other activities which require or encourage or are designed to require or encourage individuals to i drink a quantity of alcohol within a time limit other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol or ii drink as much alcohol as possible whether within a time limit or otherwise b provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic in a manner which carries a significant risk of undermining a licensing objective c provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less in a manner which carries a significant risk of undermining a licensing objective d selling or supplying alcohol in association with promotional posters or flyers on or in the vicinity of the premises which can reasonably be considered to condone encourage or glamorise anti social behaviour or to refer to the effects of drunkenness in any favourable manner e dispensing alcohol directly by one person into the mouth of another other than where that other person is unable to drink without assistance by reason of disability 4 The responsible person must ensure that free potable water is provided on request to customers where it is reasonably available 5 1 The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol 2 The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy 3 The policy must require individuals who appear to the responsible person to be under 18 years of age or such older age as may be specified in the policy to produce on request before being served alcohol identification bearing their photograph date of birth and either a a holographic mark or b an ultraviolet feature 6 The responsible person must ensure that a where any of the following alcoholic drinks is sold or supplied for consumption on the premises other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container it is available to customers in the following measures i beer or cider pint ii gin rum vodka or whisky 25 ml or 35 ml and iii still wine in a glass 125 ml b these measures are displayed in a menu price list or other printed material which is available to customers on the premises and c where a customer does not in relation to a sale of alcohol specify the quantity of alcohol to be sold the customer is made aware that these measures are available 7 1 A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price 2 For the purposes of the condition set out in paragraph 1 a duty is to be construed in accordance with the Alcoholic Liquor Duties Act 1979 b permitted price is the price found by applying the formula P D DxV where i P is the permitted price ii D is the amount of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol and iii V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol c relevant person means in relation to premises in respect of which there is in force a premises licence i the holder of the premises licence ii the designated premises supervisor if any in respect of such a licence or iii the personal licence holder who makes or authorises a supply of alcohol under such a licence d relevant person means in relation to premises in respect of which there is in force a club premises certificate any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question and e value added tax means value added tax charged in accordance with the Value Added Tax Act 1994 3 Where the permitted price given by Paragraph b of paragraph 2 would apart from this paragraph not be a whole number of pennies the price given by that sub paragraph shall be taken to be the price actually given by that sub paragraph rounded up to the nearest penny 4 1 Sub paragraph 2 applies where the permitted price given by Paragraph b of paragraph 2 on a day the first day would be different from the permitted price on the next day the second day as a result of a change to the rate of duty or value added tax 2 The permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day 8 Any individuals carrying out security activities at the premises must be licensed by the Security Industry Authority This does not apply where the premises are being used primarily as a Qualifying Club under a Club Premises Certificate under a Temporary Event Notice or primarily as a cinema restaurant or theatre Annex 2 Conditions consistent with Operating Schedule None Annex 3 Conditions attached after a hearing by the licensing authority Conditions applying to both Ground and First Floor 1 Osman Zinnureyin is permanently removed as DPS 2 The internal door between the ground floor pub and the basement is to be kept locked at all times during licensable activities 3 The premises shall be cleared of all customers by closing time 4 Only alcohol purchased on the premises may be consumed on the premises 5 The back garden shall be clear of customers by 22 30 hours and not used thereafter 6 Customers wishing to smoke shall be directed to a smoking area at the front of the premises or as otherwise agreed with the Licensing Authority or Police 7 Smokers outside the front of the premises will be limited to 15 persons 1 These contain all the conditions in the Action Plan as amended at the interim steps hearing on 11 April 2018 save for the reference to the ID Scanner 8 Signage will be in place reminding customers to Please respect our neighbours and keep noise to a minimum whilst in the area in any external areas which are accessible to customers 9 The premises shall not host any externally promoted events 10 The premises licence holder will install operate and maintain a digitally recorded CCTV system on the premises This shall cover both internal and external areas Cameras shall be located by all ingress egress points that shall be capable of capturing an image of evidential standards This shall include any search areas Any CCTV footage shall be kept for a minimum of 31 days and shall be made available to police or any other responsible authority as practicable and in any event within 72 hours of being requested in accordance with Data Protection and the company s registration with the Information Commissioner There is to be a member of staff present on the premises at all times whilst the premises are open who is trained to operate the CCTV system 11 The Challenge 25 Think 25 proof of age scheme shall be operated at the premises All customers who appear to be under the age of 25 will be challenged to prove that they are over 18 when attempting to purchase alcohol Acceptable forms of ID are limited to photo driving licence passport or Home Office approved identity card bearing the holographic PASS mark If the person seeking alcohol is unable to produce an acceptable form of ID no sale or supply of alcohol shall be made to or for that person 12 A refusals log must be kept at the premises and made immediately available on request to the Police or an Authorised Person The Refusals Log is to be inspected on a monthly basis by the DPS and noted in the log and a record made in the log of any actions that appear to be needed to protect young people from harm The log must record all refused sales of alcohol and include the following The identity of the member of staff who refused the sale The date and time of the refusal The alcohol requested and reason for refusal Description of the person refused alcohol 13 All staff shall be trained in the law about the sale of alcohol Such training will include challenging every individual who appears to be under 25 years of age and to refuse service where individuals cannot produce acceptable means of identification acceptable forms of ID and using the Refusals Log Such training including refresher training will be logged and provided not less than every 12 months The training log will be made available for inspection by Police and Authorised Persons 14 The following posters shall be displayed conspicuously on the premises in customer facing areas Think 25 to advise potential purchasers that suitable proof of age will be required for all purchasers who appear to be under 25 15 When the premises are open for business the DPS must be present at the premises and responsible for the management of the premises 16 When the DPS is away a nominated deputy who holds a personal licence and whose details have been provided to the police in advance shall fulfil this role 17 Hand held or archway metal detectors will be used as appropriate when carrying out searches 18 The management shall have a search policy for the premises as a condition of entry any patron refusing to be searched shall be refused entry 19 Customers shall not be permitted to take open drinking vessels with them when they leave the premises or into any designated smoking area 20 The Premises Licence Holder DPS shall have a written dispersal policy with regards to minimizing any noise disruption during closure of premises This shall include Customers who have pre ordered taxis shall be encouraged to remain within the premises until their taxis arrive Taxi telephone numbers shall be available for all customers The management shall actively engage with taxis and companies to discourage use of horns on arrival 21 Any designated smoking area shall be clear of customers at least 15 minutes prior to closing time 22 Promotional literature including web pages and tickets produced by or for the Licence Holder will give prominence to information regarding public transport options and request patrons to leave the area quietly 23 References by any such literature regarding road access by private transport will be subordinate to references to travel by public transport 24 Literature will also refer to the existence of controlled and restricted parking zones within the local area 25 Notices will be displayed stating that the proprietors will not tolerate drug use on the premises 26 A Noise Limiting Device shall be connected to all permanent music and public address equipment other than that used for fire evacuation The sound limiter should be tamper proof and be installed and maintained with maximum sound levels to be agreed with the Royal Borough of Greenwich Pollution Team to ensure inaudibility in nearby noise sensitive premises The limiter device shall also be connected to the doors of the front facing lobby so that the power to the amplifiers will be cut when both an internal and an external lobby door are opened simultaneously Note this condition is to be complied with no later than 4 weeks from the date of the decision notice being issued following the review hearing held on 25 4 18 27 Regulated Entertainment shall not be permitted to play in any of the external areas of the premises nor shall any music played within the building or amplified music or voices be audible at the fa ade of all noise sensitive premises 28 Doors and windows shall remain closed during regulated entertainment except for ingress and egress 29 There will be no dedicated dance floor on the premises 30 The premises shall maintain a written incident log at the premises which will be viewed weekly by the DPS and premises licence holder who will sign and date the log on inspection It will be made available on request to an authorised officer of the Council or the Police It will record the following All crimes reported to or by the venue All ejections of patrons Any complaints received Any incidents of disorder All seizures of drugs or offensive weapons Any faults in the CCTV system or searching equipment Any visit by a relevant authority or emergency service 31 All incidents of crime and disorder which take place within the premises or its immediate vicinity and involve patrons from the premises shall be reported to the Metropolitan Police within 24 hours A note of this report and the reference number shall be kept in the incident log Additional Conditions applying to Ground Floor only wine bar gastro pub 32 Food shall be available to customers throughout the premises at all times it is open to the public for licensable activities 33 On Friday and Saturday nights from 21 00hrs until 30 minutes after the premises closes to the public at least 2 SIA door supervisors must be employed at the premises and provided by an external SIA registered company At all other times door supervisors are to be employed on a risk assessed basis This condition may be varied for specific events if the licence holder is given written permission by a police licensing officer Additional Conditions applying to First Floor only restaurant 34 Save for pre booked private functions The supply of alcohol in the first floor restaurant shall be ancillary to the consumption of a table meal All sales of alcohol must be by waiter waitress table service The premises shall be laid out in a restaurant style at all times Substantial food shall be available at all times 35 Any customer entering the ground floor pub via the internal access from the restaurant will be subject to the same entry requirements as those entering the pub via its external entrance Annex 4 Plans The premises shall be maintained in accordance with the plan annexed to this Premises Licence and licensable activities shall only take place in those areas designated on the annexed plan Drawing Number 112 02A dated May 2005
